They will do autopsy first (this should be a "forensic" case since there is a law suit involved). Then the family will hire a lawyer and the hospital will be sued if the lawyer think there is a case. Usually the hospital will settle the case with money (of course both parties have to be in agreement of the amount of money) because they know they will lose the case even in the court if it is an accident.
